Roadmap for Adjusting Land Price Table in Ho Chi Minh City - Land Market Information

On the afternoon of August 29, 2024, the Ho Chi Minh City Department of Natural Resources and Environment provided the media with information about the roadmap for adjusting the Land Price Table in the city according to the Land Law 2024.

The roadmap for adjusting the land price table consists of three phases:

Phase 1: August 1, 2024 - December 31, 2025
This phase involves adjusting the land price table to match the actual situation on the ground according to Clause 1, Article 257 of the Land Law 2024. The Department of Natural Resources and Environment stated that the adjustment will follow the procedures outlined in Article 17 of Government Decree No. 71/2024 on land pricing. District and city authorities will collect and submit land price data to the Department. Consultants will then compile, analyze, and evaluate the appropriateness of the adjusted land prices relative to the actual market conditions in the city to develop the revised land price table. The authority for adjusting the land price table during this phase lies with the Ho Chi Minh City People's Committee according to Clause 1, Article 257 of the Land Law 2024 and Clause 6, Article 17 of Government Decree No. 71/2024.

Phase 2: January 1, 2026 - December 31, 2026
Currently, the Department of Natural Resources and Environment is preparing to present the plan for the first-time implementation of the land price table starting January 1, 2026, as per Clause 3, Article 159 of the Land Law 2024. The authority to approve the land price table in this phase rests with the Ho Chi Minh City People's Council.

Phase 3: January 1, 2027 and Beyond
Ho Chi Minh City will adjust, amend, and supplement the land price table to be published and applied from January 1 of the following year, as stipulated in Clause 3, Article 159 of the Land Law 2024.

Regarding the suggestion to "consider land prices in some areas with limited infrastructure, economic, and social conditions," the Department of Natural Resources and Environment has acknowledged this feedback and forwarded it to the consulting unit for study, evaluation, and adjustment of land prices to match the actual conditions in these areas.

The results of feedback and adjustments to the land price table will be reviewed and assessed by the city's land price appraisal council. The Department of Natural Resources and Environment also highlighted the need to assess the impact on certain affected groups, focusing on land use change for households and individuals.

This issue has received the most feedback during the organization of meetings and is a key concern for the advisory agency in drafting the documents.

However, in principle, the land price table must reflect the prevailing market land prices under normal conditions, according to the Party's policy in Resolution 18-NQ/TW 2022 on land management and the Land Law 2024. The levels and rates for this obligation will be stipulated in documents issued by central agencies.

The Department has advised the Ho Chi Minh City People's Committee to report and recommend that the Prime Minister approve the delegation of relevant ministries to advise, develop, and issue policies on collection levels and rates to match the adjusted land prices in the local area.
